1. General provisions
Cognitive Apps Software Solutions Inc. offers access to Aiki, including access to all information, tools, products and services available in the Mobile Application for the user, subject to the user's full and unconditional consent to all terms, policies and notices set out herein.
2. Requirements for the Mobile Application user
You agree not to use Aiki for purposes prohibited by law, or to violate the rights of Cognitive Apps Software Solutions Inc. or any other person, or to violate any laws in your jurisdiction (including, without limitation, copyright laws).
You may not distribute or use any malicious software or code of a malicious nature. Violation of any of these Terms shall result in the immediate termination of your access to our Mobile Application.
We reserve the right to refuse service to any user for any reason at any time.
You acknowledge that your content may be transmitted in unencrypted form, including transmission over various networks, including unsecured ones.
You agree not to reproduce, duplicate, copy, sell, resell, or use any content contained in Aiki, including but not limited to the following items:
articles, texts, courses, fonts, design objects, animations, computer graphics, or access to the Mobile Application itself, for purposes unrelated to the intended use of the Mobile Application, without our written consent.
By installing Aiki on your Device and creating a user account, you get access to certain sections and functions of the Mobile Application for free, and you also agree to receive periodic special offers, marketing newsletters and messages related to the Product via electronic communication channels. You can unsubscribe from commercial emails at any time by following the unsubscribe instructions in these messages.
The user account and subscription shall not be transferable and therefore cannot be sold, exchanged or transferred in any way to third parties.
Aiki account holders can access the features, tools, and content contained in the Mobile Application in three ways:
- Free basic version of Aiki, which provides access to analysis tools and part of the information content contained in the Mobile App;
- Free 3-day trial period of Aiki "premium" version, which provides unlimited access to all features and content contained in the Mobile App.
- Paid subscription to Aiki "premium" version that provides unlimited access to all features and content contained in the Mobile Application.
Please note that your purchase of a subscription through the Apple Store is subject to the applicable Apple payment policy. Refund in case of refusal of a subscription are also governed by the policy of Apple.
Aiki offers a subscription to the "premium" version for a year. The annual subscription period is 365 calendar days
Our subscription is paid in advance as a one-time payment with automatic annual renewal. You acknowledge and agree that Cognitive Apps Software Solutions Inc. is authorized to charge you for subscription fees in the amount set at the time of initial purchase, as well as funds for subscription renewal in the amount equal to the subscription price at the time of renewal. Payment is charged based on the method you use to pay for your subscription.
To avoid being billed for subscription renewal, you shall cancel your subscription before it is renewed.
Partial Refunds for unused subscription periods are not allowed.
You are not allowed to use Aiki for commercial purposes. You may not use any of the materials contained in our app for commercial purposes without our written consent. The materials contained in the Mobile Application may not be copied or distributed, republished or transmitted to third parties in any way without our prior written consent. Any unauthorized use or violation of these Terms shall immediately and automatically terminate your right to use the Mobile Application and may result in liability as provided by law.
You also may not use any content, code, data or materials contained in Aiki in a way that is not provided for by the functionality of the Mobile Application, in particular: upload the Mobile Application to third-party resources, publicly display, copy, reproduce, distribute, modify, transfer to third parties, create derivative works, sell or use in any other unintended way.
Aiki®, the Aiki logo, and all other marks of Cognitive Apps Software Solutions Inc. products or services are trademarks. All intellectual property, trademarks, logos, images, product and company names displayed or mentioned in the Products are the property of their respective owners. Using the Mobile Application shall not grant you any licenses or rights to use, modify, delete, or copy such materials. Misuse of trademarks contained in the Mobile Application is strictly prohibited. Cognitive Apps Software Solutions Inc. shall protect its trademark rights to the full extent provided by law, including up to criminal prosecution.
The materials and data provided by the Mobile Application are provided for general information only and should not be used as the sole basis for making decisions without consulting specialists. You rely on the materials and data contained in our Mobile Application at your own risk.
Aiki is a tool for monitoring your well-being and providing informational content in the field of mental health. We are not a provider of medical services or medical equipment, and our Product should not be considered medical. To make a diagnosis or get medical help, you need to contact your doctor. We do not claim, represent, or guarantee that Aiki can provide therapeutic or other medical care.
Any information provided by Aiki or third-party authors who post content in the Mobile Application is provided simply for your convenience.
Any tips or other materials in the Mobile Application are intended for general informational purposes only. They are not intended to be relied upon, and they are not a substitute for professional medical advice based on your individual condition and circumstances. The recommendations and other materials we provide are intended to improve the interaction between you and your health care providers, not to replace them. We are not responsible for the consequences of your actions based on what you have read or learned while using our Mobile Application, as you take full responsibility for your decisions and actions. In particular, to the maximum extent permitted by law, we make no representations or warranties as to the accuracy, completeness or fitness for any purpose of the recommendations, other materials and information published in the Mobile Application.
We do not guarantee or represent that the provision of our services will be uninterrupted, timely, secure or error-free.
We do not guarantee that the results that can be obtained when using the Mobile Application will be accurate or reliable.
You agree that we may suspend the Mobile Application for an indefinite period of time or stop providing it at any time without prior notice.
All products and services provided to you through the Mobile Application are provided (except as expressly provided by us) in an "as is" and "as available" format, without any representations, warranties or conditions of any kind, vivid or implied.
In no event shall Cognitive Apps Software Solutions Inc., our founders, officers, employees, affiliates, agents, licensors, contractors, interns, service providers, or licensors be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, or any other damages of any kind, including, without limitation, lost profits, lost savings, loss of data, equipment replacement costs, or any other such damages, whether based on the requirements of contracts, regulations, or otherwise.
Because some countries, states or jurisdictions do not allow the exclusion or limitation of liability for indirect or consequential damages, in such countries, states or jurisdictions our liability is limited to the maximum extent permitted by law.
7. Changes in the Mobile Application.
Detailed information about the Mobile Application and the services we offer may be changed by us unilaterally.
You acknowledge and agree that we provide access to the Mobile Application in an "as is" and "as available" format.
We reserve the right to change or discontinue the Mobile Application (or any part of it) at any time without prior notice.
We will not be liable to you or any third party for any changes to the Mobile Application, including price changes, suspension or termination of services.
8. Third-party products, services and tools.
We may provide you with access to third-party tools, products and/or services that we do not control, do not guarantee their operation, and are not responsible for the content they provide.
You acknowledge and agree that we provide access to such tools, products, and/or services in an "as is" and "as available" format without any warranties, representations, or conditions of any kind. We do not accept any liability arising from your use of third-party tools, products or services.
Any use of additional tools offered through the Mobile Application is at your own risk and discretion, and you must ensure that you are familiar with and approve of the terms on which the tools are provided by the relevant third-party providers.
Aiki allows you to link your user account to a valid account on a third – party social network or email service (hereinafter referred to as a Third-party account). In this case, Aiki shall have access to your Third-party account in accordance with the applicable terms governing your use of each Third-party account.
You represent that you have the right to disclose information to access your Third-party account to Aiki and/or grant the Mobile Application access to your Third-party account (for the purposes described in this document, but not limited to), without violating any of the terms and conditions governing the use of the relevant Third-party account. You also represent that the terms and conditions governing your use of the relevant Third-party account shall not oblige Cognitive Apps Software Solutions Inc. to pay any fees or impose any restrictions on Cognitive Apps Software Solutions Inc.'s use of third-party services.

Our app may contain information that contains typos, inaccuracies, or omissions that may relate to features, our service, promotions, offers, and terms of service availability. We reserve the right to correct any errors, inaccuracies or omissions, and to change or update information if any information posted in the Mobile Application is inaccurate at any time without prior notice (including after you have subscribed to our Mobile Application),
We do not undertake any obligation to update, change or update information in the Mobile Application, except as required by law.

The transfer of this license allows us, among other things, to use, copy, modify, create derivative works and otherwise use your offers for any purpose.
